Recreation Equipment Loan Form

1. Procedure for Loaning Equipment

If the equipment is not returned or is returned damaged, the West Hants Regional Municipality has the option to charge the stated value of the borrowed equipment against the borrower and/or report stolen goods to the RCMP.

a)      Equipment will be loaned on a first come/first served basis with priority given to residents of the West Hants Regional Municipality. Requests from other areas will be reviewed on a case-by-case basis by West Hants Community Development staff.  High demand on the equipment may result in a waiting time for borrowers.

b)      Groups/Individuals will only be permitted one loan per month.  Certain restrictions/exceptions may apply.

c)      Requests to borrow any equipment should be made at least one week in advance by contacting the West Hants Community Development Department to accommodate the request.

d)      Equipment will be loaned for a maximum period of five days, depending on availability.

e)      Equipment loans will be available for pick-up at three locations: Windsor, Summerville, and Southwest Hants Fire Department.

           i.      At Windsor, Pickup is on Thursdays and Drop offs are on Tuesdays.

           ii.      In Summerville, pickups are on Thursdays and drop offs are on Mondays.

           iii.      At the Southwest Fire Department, pickup is Thursday and Drop offs are on Mondays.

f)       It is the responsibility of the borrower to arrange pick-up and drop-off of equipment during scheduled times. To arrange an appointment, the borrower must contact the Community Development Department.

g)      Individuals borrowing kayaks and/or paddleboards MUST load and unload equipment unassisted from Municipal Staff / Volunteers.  It is strongly encouraged for borrowers to bring assistance for the load and unload.

h)      Community Development staff will review the equipment, its proper usage, and functions with the borrower prior to loaning.

i)        Community Development staff will inspect equipment for damage when returned to ensure it is in good working condition. Any damages or lost items may be charged to the borrower for the stated value/repair cost.

j)        The Recreation Equipment Loan Form and Release Agreement must be filled out before equipment will be loaned.

 2. West Hants Regional Municipality Responsibilities: 

  1. West Hants Regional Municipality will maintain and annually renew insurance coverage for the kayak & paddleboard equipment. 

  2. West Hants Regional Municipality agrees to manage scheduling of equipment. 

  3. The Municipality / Volunteers have the right to refuse the loan/use of equipment based on safety.  This includes but is not limited to  suspected drug or alcohol consumption, inclement weather conditions, unsafe water conditions. 

  4. West Hants Regional Municipality will be responsible for regular maintenance and will ensure that equipment is in good working condition before and after every use. 

3. Borrower’s Responsibilities:

a)      The borrower is responsible for the equipment and will make every effort to ensure the equipment is used and stored in a proper and safe manner.

b)      The borrower agrees to return the equipment in the same condition as when it was received, except for normal wear and tear. This involves cleaning the equipment and removing any dirt, sand, or mud, after use/before returning. Any damage to equipment, beyond normal wear and tear which will be charged to the borrower.

c)      The borrower will not alter the equipment or change the use for which it is intended.

d)      The borrower will hold responsibility for all users of the equipment while they are under this loan agreement.

e)      The borrower agrees to return the equipment at the agreed upon time on the designated date written on the loan form.   The borrower further agrees that if the equipment is not returned on the return date that they will be reported to the RCMP as stolen goods.

f)       The borrower will ensure that all the safety equipment provided is always used while equipment is in use.

g)      The borrower must be 19 years or older.

h)      The kayak equipment carries a weight restriction of 90 lbs – 300 lbs. The youth paddleboards carry a weight restriction of 60lbs - 140lbs.  The adult paddleboards carry a weight restriction of 120lbs – 230lbs, the junior paddleboards carry a weight restriction of 170lbs. The borrower acknowledges that the users fall within these weight restrictions. No children under the minimum weight requirement are permitted to use the kayaks/paddleboards.

i)        The borrower is aware of the inherent risks, hazards, and dangers associated with the use of kayaks/paddle boards and associated equipment and the transportation of kayaks/paddle boards and associated equipment and fully assumes all such risks, damages, and hazards.

j)        The borrower agrees not to use the kayaks/paddleboards or associated equipment or allow other users to use the kayaks/paddleboards or associated equipment, while under the influence of substances, including but not limited to, alcohol, marijuana, or other drugs.

k)      The borrower acknowledges and accepts that the West Hants Regional Municipality / Volunteers take no responsibility for the use or transportation of kayaks/paddle boards and/or associated equipment by users who are under the influence of drugs, alcohol, or other substances. 

l)        The borrower acknowledges and accepts that the West Hants Regional Municipality / Volunteers take no responsibility for the use or transportation of kayaks/paddle boards and/or associated equipment by inexperienced users.

m)   The borrower understands that no person under the age of 19 is allowed to use a kayak and/or paddle board or associated equipment unless supervised by a responsible adult. 

n)      The borrower states that they have carefully read the Kayak/Paddle Board Equipment Loan Agreement Addendum related to use of the kayaks/paddle boards by minors. 

o)      The borrower acknowledges and accepts that the West Hants Regional Municipality / Volunteers take no responsibility for the use or transportation of kayaks/paddle boards and/or associated equipment by minors, and/or under-supervised minors.

4. Equipment Loan Agreement

I/we hereby agree to use the equipment in a careful and prudent manner and agree to reimburse the West Hants Regional Municipality for the full value of the above equipment if the above equipment is lost, damaged, or destroyed.  It is hereby understood that the value of the above is the value to be determined by the West Hants Regional Municipality.  Furthermore, I/we the undersigned, agree not to hold the West Hants Regional Municipality, or any of its agents or subsidiary properties/equipment liable for any injuries sustained by any persons registered by me/us while a participant of this program.  I/we agree to return all equipment on the agreed upon date and time as indicated at the bottom of this form.
